  Article 69-Offences of polygamy  
69.1 Polygamy  
  Polygamy is when a spouse (male or female) in a legal union (de facto or marriage) is at the same time in another active formal legal union (de facto or marriage) with at least one other man or woman of the same or opposite sex.  
 
 Primary Fact(s)
 1. That an accused man or woman is currently registered in a legal union; and
 2. That the accused man or woman has deliberately and intentionally entered into a second or more legal unions while the first remains active.
 
 
 Penalty Conditions (Level 1-Crime)

a) if a single count of polygamy with previous spouses separated for more than twelve months, with no children, having failed to complete divorce application;
4-6
a) if a single count of polygamy with previous spouses separated for more than six months, with no children, having failed to complete divorce application;

a) if a single count of polygamy with previous spouses separated for more than twelve months, with children, having failed to complete divorce application;
4-6
a) if a single count of polygamy with previous spouses separated for more than six months, with children, having failed to complete divorce application;
